Terms and Conditions

General information

Tiyulim LLC DBA NBATrips, “NBATrips”, is the “Provider” of NBATrips experiences referenced herein, in the NBATrips Privacy Policy, in the NBATrips Cookies Policy, and otherwise throughout www.nbatrips.com. For purposes of these terms and conditions, our privacy policy, and our cookies policy, references to “you” or “your” includes you and all other people in your party. Additionally, for purposes of these terms and conditions, persons seeking to participate in an NBATrips experience may be referenced as “participant(s)” or “guest(s)”. Where the term “group” is referenced, it means the entire collection of individuals that are participating in an NBATrips experience. These terms and conditions cannot be altered except in writing by an officer, or a person authorized by an officer, of NBATrips.

Your agreement is with NBATrips, and a contract is formed when you make a reservation with us that we accept. Evidence of our acceptance of your reservation is NBATrips’ confirmation to you of your non-refundable deposit. Booking and payment for a trip shall constitute your acceptance of these terms and conditions. NBATrips reserves the right to change these terms and conditions at any time prior to you making a reservation with NBATrips. All contracts with NBATrips are subject to the terms and conditions set forth herein.

If a provision herein is invalid or unenforceable, it shall not affect the validity or enforceability of any other provisions. The contract shall be construed as though the invalid or unenforceable provision was not contained herein and was replaced with a valid and enforceable provision as similar as possible to the original provision. Should any conflict arise between these terms and conditions and those contained within other materials, these terms and conditions shall apply.

Included in the price of an NBATrips experience

Air travel from your home location airport to an airport near the NBATrips experience destination.
Group ground travel from the NBATrips experience destination airport and throughout the NBATrips experience.
Group hotel accommodations.
Admission to NBA games, as specified in each NBATrips experience.
Unique and special events that may be arranged by NBATrips on occasion for certain NBATrips experiences; these unique and special events are not guaranteed or disclosed in advance.

Not included in the price of an NBATrips experience

Travel to and from the airport in your home location.
Upgrades in travel arrangements, hotel accommodations, and other upgrades that are not included and specified in the NBATrips experience.
Meals.
Gratuities.
Travel insurance.
Wi-Fi service.
Securing valid travel documents.
Personal expenses, such as laundry services or movement/porterage of your baggage and personal items.
All costs that are associated with you leaving an NBATrips experience before its conclusion. This includes whether you decide to leave early or because NBATrips decides that your behavior is disruptive of the NBATrips experience. Also, this includes all costs associated with changes to the original air travel that was arranged for you by NBATrips.

Payments

Your NBATrips experience will be confirmed after NBATrips receives a non-refundable deposit from you. Final payment for the remaining costs of your NBATrips experience will be due no later than 30 days prior to the departure date.

Departure Date

The departure date is the date indicated on the NBATrips booking confirmation. NBATrips experiences do not include travel time to and from an NBATrips experience destination.

Mobility, Disability, Medical

If you have reduced mobility, a disability, or a medical condition that might affect your experience with NBATrips, we ask that you provide us with full details before booking so that we can advise you on the suitability of the particular NBATrips experience for you.

Travel Insurance

Travel insurance is highly recommended for all guests covering all applicable dates of travel related to an NBATrips experience. The travel insurance should cover trip cancellation, trip interruption, personal injury, medical expenses, and it should cover evacuation and repatriation services. The choice of travel insurer is yours. NBATrips cannot be held responsible for your failure to obtain travel insurance that is appropriate for your situation. NBATrips recommends that you purchase travel insurance immediately upon booking your NBATrips experience. NBATrips will not be held liable for any costs incurred by a guest resulting from their failure to obtain adequate travel insurance.

Travel Documents

NBATrips guests are solely responsible for ensuring that they have a valid passport, as required by any country that they are traveling to or through. Additionally, NBATrips guests are solely responsible for ensuring that they have the necessary visas, as required by any country that they are traveling to or through. NBATrips will not accept responsibility or provide refunds if a guest cannot travel because the person fails to comply with passport, visa or immigration requirements, or if the person has lost or misplaced any necessary travel documents. NBATrips will not be liable in circumstances where entry into a country is denied to a guest, regardless of the reason.

Public Health

An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and/or death.

COVID-19 requirements vary by country and circumstances may require NBATrips to ask its guests to be vaccinated and provide evidence of vaccination, notwithstanding a specific country’s vaccine requirements. Evidence of negative COVID tests may also be required by NBATrips. Airlines and other transport providers may have separate requirements. It is your responsibility to ensure that you comply with these requirements. No refunds will be given if you are unable to undertake some or all your NBATrips experience due to your failure to comply with these requirements. When traveling with NBATrips, you voluntarily assume all risks related to exposure to COVID-19.

If you test positive while travelling with NBATrips, you will need to comply with the rules of the country that you are in, and you may not be allowed to continue traveling with the NBATrips group. Because COVID-19 continues to be a public health threat, we ask that you take personal responsibility for your wellbeing and be conscious of the effect your personal situation may have on the health and wellbeing of others. NBATrips reserves the right to decide that you will not be able to continue to travel with the group, should your health situation appear likely to compromise your wellbeing or that of other NBATrips guests.

Cancellation and Refunds

Due to the extensive advanced planning that is required to deliver the unique NBATrips experiences at affordable prices (e.g. airline tickets, hotel rooms, game tickets, arena events), payments for NBATrips are non-refundable. No refunds will be granted by NBATrips if an NBATrips guest or someone in the guest’s party chooses to cancel their participation after booking. Additionally, no refunds will be granted in the case of absence or early departure from an NBATrips experience, including but not limited to missed hotels, transfers, or scheduled events.

Cancellation by the Provider

NBATrips reserves the right to modify or cancel any trip, accommodation, in-destination activity, or arrangement at any time. If NBATrips takes any such action, then a cash refund will be returned to the guest within 7 days of the cancellation. Credit card transactions will be refunded following the policies and procedures of the guest’s credit card company.

Minimum Participation

Some NBATrips experiences are based on a minimum number of overall participants. If an NBATrips experience does not satisfy the minimum numbers, then NBATrips reserves the right to cancel or reschedule the experience.

Force Majeure

“Force Majeure Event” means any event or circumstance beyond the control of NBATrips, including but not limited to: (a) an act of god (such as earthquake, flood, fire, explosion, landslide, lightning, action of the elements, force of nature, washout, typhoon, hurricane, cyclone, tsunami, storm or storm warning or natural disaster); (b) industrial disputes, work ban or other labor dispute or difficulty; (c) acts of terrorism, political unrest, war or threat of war, riots or civil strife; (d) failure or delays to scheduled transportation and the closure of airports or ports; (e) pandemic, epidemic or health risk; (f) governmental and administrative actions, including closure of borders and travel warnings and restrictions.

Cancellation due to Force Majeure Events

If the Provider cancels a trip because of a Force Majeure Event, a future travel credit (FTC) for the value of funds paid to date less any third-party costs incurred will be provided. All FTCs will be valid for 24 months from the date of issue. Where a trip is terminated mid-trip due to a Force Majeure Event, if NBATrips provides you with any alternative services or assistance, such as with hotels or travel, then you agree to pay for any additional costs associated with the alternative services or assistance.

Behavior

NBATrips strives to provide best-in-class experiences and services. In doing so, we will not tolerate inappropriate, abusive, or aggressive behavior from our guests. We reserve the right to terminate the participation of any guest who assaults fellow guests, our staff, or suppliers, or any guest who disrupts the general enjoyment of others by their bad behavior. Furthermore, any such behavior may result in a guest being barred from future experience with the NBATrips. When you make a booking with NBATrips, you accept responsibility for the proper conduct of all members of your party during the duration of your travels with us. We reserve the right at any time and at our discretion to terminate the travel arrangements and/or cease to deal with any guest whose behavior, in the reasonable opinion of us or our suppliers, may cause danger or distress to anyone else or damage to property. If NBATrips terminates the participation of a guest(s) for bad behavior, no compensation of any kind will be made.

Itinerary Variations

NBATrips reserves the right to modify program itineraries, including air and ground transportation and substitute accommodations, at any time, due to unforeseen circumstances or circumstances beyond the control of NBATrips. Reasonable efforts will be made to operate itineraries as planned, but alterations may occur after the final itinerary has been issued.

Changes due to Religious, National or Public Holidays

During religious, local and national holidays, open hours of sightseeing venues, restaurants, museums and shops may be limited or unavailable. Holidays, closing days and other circumstances may necessitate a change of the day of the week for certain NBATrips activities. In such instances, itinerary changes may be made by the Provider to maximize the NBATrips experience and reduce inconvenience to guests. Such changes are deemed to be minor, not major, changes to the itinerary and, as such, no compensation will be payable to NBATrips guests for the changes.

Hotels

NBATrips always undertakes reservations at high quality hotels skillfully, providing host hotels with important information that is specific to the NBATrips’ experience and our guests, and verifying that availability is best suited to the NBATrips experience. Please note that NBATrips in not responsible in any way for the day-to-day operations of a host hotel and/or the facilities in the hotel, including its cooling and heating systems, linens regimens, water temperatures, arrangement and/or configuration of rooms in the hotel, unexpected disruptions and/or malfunctions in the hotel, or any other similar measures.

NBATrips strives to ensure that host hotels are centrally located to NBATrips experiences. NBATrips cannot guarantee that host hotels will be in the NBATrips experience destination cities. There may be cases where the host hotel will be outside the destination city in a nearby city. This is especially true during heavy exhibition and special events seasons. This does not change the essence of an NBATrips experience because the NBATrips team is experienced and chooses host hotels and their locations carefully.

When booking a room for three individuals for an NBATrips experience, where each person wishes to have her/his own bed, please be aware that host hotels may or may not be willing to add a roll-away bed to the room to accommodate this situation. In such instances where a host hotel is unwilling to add a roll-away bed because of room configurations/space limitations or policy against it, then NBATrips cannot guarantee that each person will have his/her own bed.

When booking a double room for an NBATrips experience, typically there are 2 separate beds that allow for 4 people in the room. Occasionally, a double room may have 1 bed, allowing for only 2 people in the room; you will be so advised if this situation arises. An NBATrips guest traveling alone will be paired with a roommate of the same gender. If it is determined that paired roommates are incompatible then NBATrips will make its best efforts to reassign pairings, but reassignment cannot be guaranteed. For those people interested in staying in a separate, private hotel room alone, an additional fee will apply.

NBATrips cannot guarantee that every room in a host hotel will be the same size, configuration, or on the same floor as other hotel rooms of other NBATrips guests.

Photos

NBATrips takes the privacy of our guests seriously. From time-to-time NBATrips may organize group or individual photo opportunities as part of the NBATrips experience. Such photos may be used by NBATrips for promotion or shared on social media. NBATrips will not share these images with anyone for any other use. If these conditions are not satisfactory to you, we ask that you kindly remove yourself from participation in any group or individual photos organized by NBATrips.

Disclaimer of Liability

To the maximum extent permitted by law, NBATrips shall not be responsible or liable for cancellations, delays, acts of other service providers, diversions or substitution of equipment or any act, variation, postponement, omission or default by air carriers, land carriers, hoteliers or hotels, transportation companies, or any other persons providing services or accommodations to guests, including any results thereof, such as changes in services, accommodations, or facilities. Furthermore, NBATrips shall not be liable for loss or damage to baggage or property, or for any damages or claims whatsoever arising from loss, negligence or delay from the act, error, omission default or negligence of any person not its direct employee or under its exclusive control, including any act, error, omission, default, or negligence of any country, government or governmental authority, officer, or employee. NBATrips shall not be liable for indirect, special, or consequential damages.

Disputes

Participants in NBATrips agree that any controversy or claim arising out of or related to this contract, or breach thereof, shall be settled by arbitration, and judgement on the award rendered by the arbitrator may be entered in the court of jurisdiction. This contract is deemed to be entered into in Delaware, USA. Should arbitration be ruled unenforceable, any action concerning the interpretation, enforcement, or breach of any term, obligation, or duty as contained or related to this contract shall be solely in the Superior Court of Delaware, USA.
